1. Provider
Cabotage.eu is a service of CTS, Cargo Tech Solutions, Unipessoal, Lda., a company under Portuguese law with registered office at Rua do Sol, n.º 20, 4475-382 Maia (Milheirós), Portugal, registered at the Commercial Registry under the single registration and legal-person number 518716643 (VAT PT518716643), with a share capital of EUR 1,000. Contact: info@cargo-tech.solutions.
2. Purpose
Online tool to generate, host and deliver the electronic administrative control document (DeCA) required by Spanish transport law, plus auxiliary features (cabotage counter, delivery to the driver, archive).
3. Responsibility for the data
The user enters the data and is liable for its truth and accuracy (art. 7 Orden FOM/2861/2012). CTS provides the tool and does not verify the content of the documents. Validations (VIES, plate format, cabotage counter) are informative aids and do not replace the user's obligations.
4. Availability
We strive to keep the service and the public URLs continuously available, with external monitoring. We do not guarantee the absence of interruptions. Issued PDFs are kept 18 months by default (configurable up to 5 years).
5. Plans and payment
Prices are shown excluding VAT. Payment is made through Stripe, by card or SEPA, monthly or yearly. You may cancel at any time; the plan stays active until the end of the paid period. Invoices are issued by software certified by the Portuguese Tax Authority.
6. Fair use
Plans with unlimited DeCA are subject to fair use consistent with a transport company. We reserve the right to limit abusive automated use.
7. Account and users
The account belongs to the company. The administrator may add users within the plan limit and is responsible for their access.
8. Intellectual property
The software and the Cabotage.eu brand belong to CTS. Generated documents belong to the user.
9. Limitation of liability
CTS is not liable for penalties arising from incorrect data entered by the user, nor for indirect damages. Total liability is limited to the amount paid in the previous 12 months.
10. Governing law
Portuguese law. Courts of Maia, Portugal, without prejudice to consumer rights where applicable.
11. Contracting online
The contract is concluded online: you create the (free) account, pick a plan on Pricing, confirm the payment on Stripe's secure page and receive the confirmation and the invoice by email. Before confirming you can review and correct what you entered. The terms are available in the interface languages; the Portuguese version prevails in case of discrepancy. The contract stays archived in your account (plan, invoices and history). The service is for professionals only, so the consumer right of withdrawal does not apply.
12. Complaints and disputes
Any complaint can be sent to info@cargo-tech.solutions and is answered within 10 working days. Where the law requires it, the Portuguese electronic complaints book is available at www.livroreclamacoes.pt.
